Acceptance of the General Conditions of Sale and conclusion of the contract
The contract stipulated between African Cottons Italia S.r.l. (hereinafter referred to as “African Cottons Italia”) and the Client, namely the person who possesses the ability to act or entity that makes the purchase on the Website, shall be concluded with the acceptance, including partial acceptance, of the order by African Cottons Italia. Should the order not be accepted, African Cottons Italia shall in any case provide prompt notification to the Client. By placing an order through one of the available methods, according to the ORDER FORM on the Website (hereinafter referred to as the “Order”), the Client confirms having read all the information provided during the purchase process and confirms full acceptance of these General Conditions (hereinafter referred to as the “Conditions”). These Conditions may be printed or saved on a durable medium, in accordance with the provisions of Article 12 of Italian Legislative Decree 70/2003 and Article 51 of Italian Legislative Decree 206/2005, as amended by Italian Legislative Decree 21/2014.
Purchase method
The only products offered for sale by African Cottons Italia are those shown on www.afartextiles.com at the time of placing the Order, as they are described on the relevant information pages.
However, it shall be understood that the images accompanying the information regarding a product are shown for information purposes only and may not be wholly representative of the product’s features, possibly differing in color (in some cases due to the browser and screen used to access the Website and view the images). To place an Order, the Client must fully complete the relevant form on the Website and send the same after carefully reading the Conditions as well as the features of the product and/or products that the Client intends to purchase. The Client shall also ask African Cottons Italia , if desired, to send a tax invoice for the purchase, pursuant to Article 22 of Italian Presidential Decree no. 633/1972.
Is prohibited to enter false data; personal data and e-mail address must be the only real data and not some other person or entity
By submitting an order the Client confirms to know and accept unconditionally these general terms and conditions of sale, the privacy policy. Correct receipt of the Order shall be confirmed from African Cottons Italia by email (to the email address indicated from the Client), that summarizes the Order, the purchase conditions and the details provided by the Client, so that the Client may check if everything is correct and communicate any necessary corrections without delay.
Prices and Payment Methods
The prices indicated on the Website shall be in Euro and shall be understood as inclusive VAT if applicable based on the country of delivery.
For countries outside the European Union the Vat will be deducted when the order is processed. Any delivery costs or payment charges shall in any case be notified to the Client via the Website or through these Conditions. African Cottons Italia reserves the right to modify the prices mentioned on the site at any moment. Under no circumstances will African Cottons Italia be accountable for possible price variations.
The following payment methods are accepted:

The transaction will be made through Stripe’s secure server or other secure server chosen by African Cottons Italia. In no case and at no stage of the payment will African Cottons Italia be able to know the information relating to the customer’s credit card
Delivery of products and associated charges
The products purchased will be shipped within 5 days from order confirmation, unless otherwise communicated. The delivery to the address indicated on the Order by the Client happens, about the deliveries in Italy, by 2-3 days from the shipment, with the exception of the islands where the delivery time may be longer. For deliveries requested outside of the European Union, delivery times vary from country to country and may be longer than 3 working days. African Cottons Italia will provide information on delivery times upon request.
For shipments to Italy, the Customer is required to pay a contribution of 14.60 Euros for purchases of less than 50.00 Euros, above this amount no shipping costs will be charged.
For shipments to countries EU+ UK, Swiss, Norway, and Iceland, the Customer is required to pay a contribution of 18.00 Euros for purchases of less than 50.00 Euros, above this amount no shipping costs will be charged.
For shipments to the United States, the Customer is required to pay a contribution of 20.00 Euros for purchases of less than 70.00 Euros. Above this amount, no shipping costs will be charged.
We also ship to other countries: Japan, Russia, South Korea, Rwanda, Tanzania, South Africa, Kenya and Canada. The customer is required to pay a contribution of 55.00 euros regardless of the amount of purchases. Contact our customer service for shipment to other countries.

The contribution for the shipping costs is indicated separately from the price of the Product. The customer can see the cost of shipping at the end of completing the order before the confirmation request,
The lead times for delivery indicated by African Cottons Italia are merely indicative and a delay to the same, or any delivery made with subsequent split consignments shall not entitle the Client to refuse the delivery or request compensation or indemnity.
At the time of delivery, the Client shall be required to check:
that the number of packages delivered corresponds to the number shown on the delivery note.
that the packaging (including the material to seal the carton) is intact, not damaged, or wet or spoiled.
For any damage to the packaging and/or any lack of correspondence in the number of packages or other missing details, the Client must ask the carrier to write in capital letters on the consignment note:” we accept with reserve after checking and within 24 (twenty-four) hours he must report the problem to African Cottons Italia by e –mail at customercare@afartextiles.com.
The delivery procedure provides that, in the absence of the consignee, the carrier will leave a note in order to conclude the delivery in an other time The note indicates the address and the telephone number to contact the Carrier in order to arrange the delivery.
If the parcell is not delivered for reasons dependent on the customer (wrong address, consignee always absent, incorrect phone number) or if the Client refuses the delive , the shipping costs and any customs charge will be deduct from refund due to Client.
Right of withdrawal
Pursuant to Article 52 of Italian Legislative Decree 206/2005 (Consumer Code) , as amended by Italian Legislative Decree 21/2014, the Client may withdraw from the Conditions and therefore from the purchase agreement for any reason, without need for an explanation and without incurring any penalty, within 30 (thirty) working days from the date of receiving the products.
In order to exercise the above mentioned right the Client shall send notification to African Cottons Italia within the time limits indicated to the following email address customercare@afartextile.com.
In the event of cancellation, the Client shall return the products to African Cottons at the Client’s expense within 14 (fourteen) days of said cancellation to the following address:

The goods must be returned intact, complete in all their parts and in their original packaging (envelopes and packaging), having been kept and used only for the time strictly necessary to establish and verify their condition, features and size, in accordance with normal diligence, there being no signs of wear or dirt and in compliance with the following conditions:
the right to cancel may be applied to the purchased product as a whole; it is not in fact possible to return only part of the purchased product (for example, accessories, complementary items, etc.);
in order to cancel, the product must be complete and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessories: labels, cards, tags, seals, etc.);
until confirmation of receipt by the warehouse indicated by African Cottons Italia is given, liability for transport shall be borne solely by the Client;
should the goods be damaged in transit, African Cottons Italia shall notify the Client, in order that the Client may promptly lodge a complaint against the courier that was used and obtain appropriate compensation; the product shall then be made available to the Client, at the same time as cancelling the request for termination;
African Cottons Italia shall not be liable in any way for damage, theft or loss that occurs during or as a result of a shipment made for the purposes of returning goods.
Italia shall arrange to refund the Client for the whole amount paid, within 14 (fourteen) days from receipt of return, by transferring the debited amount.
African Cottons Italia refund the customer for the price of the product plus the transport costs for sending the product to the customer. The transport costs for the return remain the responsibility of the customer unless African Cottons has expressly exempted the customer from such expenses
In any case, the Client shall forfeit the right to cancel if African Cottons Italia should discover any of the following:
that the returned product and/or its accessories, and/or its packaging are not intact;
that the product is without its external package and or the original internal packaging;
that the product is missing some of its integral parts and/or accessories (for example fastenings, ties, buckles, etc.).
Should the right to cancel be forfeited, African Cottons Italia will arrange to return the purchased product to the sender, debiting the shipping costs from the same and, if already refunded, the price of the product.
Warranties
The products sold by African Cottons Italia are covered by a legal guarantee of conformity established by Art. 128 et seq. of the Consumer Code (Italian Legislative Decree 206/2005)., applicable, in any case, to the consumer only. Pursuant to the law, the seller is obligated to deliver goods to the Client that comply with the sale contract.
To benefit from assistance under the warranty, the Client must retain the invoice or the payment receipt, along with the delivery note.
The Seller shall be liable to the Client for any non-conformity of products that exists at the time of delivery of the aforementioned goods, or that occurs within 24 (twenty-four ) months of delivery.
To qualify for the above-mentioned guarantee, the Client must notify the African Cottons Italia of the non-conformity within 2 (two) months of its discovery, or this right will be forfeited, by contacting African Cottons Italia by e-mail .
The warranty for lack of conformity shall be applicable provided that the product concerned has been used correctly, in accordance with its intended use and in compliance with the contents of the instructions for usage and laundering provided in and/or with the product.
Any defects or damage caused by accidental means or those attributable to the Client or those caused by use of products in a way that does not comply with its intended use or normal wear and tear are excluded from the non-conformity and, therefore, from the legal guarantee. Should African Cottons Italia, for any reason, not be able to provide the Client with a product under the warranty (repaired or replaced), or should repair or replacement be excessively burdensome, due to the value of the product, African Cottons Italia may proceed by applying an appropriate discount on the price paid, or by refunding the whole amount paid and terminating the contract.
Where the implementation of the warranty requires the product to be returned, the same must be returned by the Client in its original packaging, complete in all its parts (including packaging and any documentation and accessories).

Applicable law
The contract for sale set out in these Conditions and its performance shall be governed by Italian Law. Any contrary legal norms and the United Nations Convention on Contracts for the International Sale of Goods shall not be applicable. The competent court is that of the place of residence or domicile of Client if located in the territory of the Italian State.
African Cottons Italia does not guarantee in any way that materials present on the website are in accordance with current regulations of other countries, and the access to those materials from places where the relative contents are illegal is expressly prohibited. Users who choose to enter this website from said locations do so at their own risk and are solely responsible to respect relative local laws.

Trademarks, logos and other distinguishing signs on the site belong to their respective owners. The sales agreement is presented in 2 languages: Italian and English.
In case of discrepancies in the translation, the Italian language version shall prevail.
